Please read these Terms of Service ("Terms") carefully before using the 254rent platform ("Service") operated by 254rent ("we", "us", or "our").

1. Acceptance of Terms

By accessing or using 254rent, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

254rent is an online platform that connects property owners, landlords, and agents ("Landlords") with individuals seeking rental properties ("Tenants"). We provide a marketplace for listing and discovering rental properties in Kenya.

We do not own, sell, or rent properties. We are a platform that facilitates connections between Landlords and Tenants.

3. User Accounts

3.1 Account Registration

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Use of Service

4.1 Permitted Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Post false, misleading, or fraudulent information
• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Transmit any viruses, malware, or harmful code
• Attempt to gain unauthorized access to the Service
• Use automated systems to access the Service without permission
• Harass, abuse, or harm other users

5. Property Listings

5.1 Landlord Responsibilities

Landlords are solely responsible for the accuracy of property listings, including descriptions, photos, prices, and availability. Landlords must ensure they have the legal right to rent the property.

5.2 Listing Content

All property listings must comply with applicable laws and regulations. We reserve the right to remove any listing that violates these Terms or is deemed inappropriate.

6. Transactions and Payments

6.1 Rental Transactions

All rental transactions are between Landlords and Tenants. 254rent is not a party to any rental agreement and does not facilitate payments between parties. We do not collect rent or deposits on behalf of Landlords.

6.2 Subscription Fees

Landlords may be required to pay subscription fees for Premium features. All fees are non-refundable except as required by law or as explicitly stated in our refund policy.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by 254rent and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you post on the Service. By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content for the purpose of operating and promoting the Service.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

We do not verify the accuracy of property listings or the identity of users. Users are responsible for conducting their own due diligence before entering into any rental agreement.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 254RENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. Indemnification

You agree to indemnify and hold harmless 254rent, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service, violation of these Terms, or infringement of any rights of another.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may terminate your account at any time by contacting us or using the account deletion feature in your account settings.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
